SUBROGATION IN AUTO ACCIDENT CASES

            Subrogation is a legal remedy available to entities that pay for medical treatment caused by the negligent driver, when the victim attempts to make a recovery of damages from the negligent driver’s insurance company.  The usual entities with subrogation liens are Medicare, Medicaid, Health Insurance Companies, The Veteran’s Administration, Worker’s Compensation, and Hospitals who file a Hospital Lien.  Subrogation rights only come into play when the victim attempts to recover money damages from the insurance carrier for the negligent party.  Subrogation basically means that if the victim recovers money damages from the negligent party’s insurance carrier, then the entity that paid money to doctors and hospitals for the treatment of the injuries gets to step in and get reimbursed for what they paid, out of the first money paid in settlement.

            If the insurance carrier for the negligent third party or the victim’s attorney knows of the subrogation lien, and settles the case and disburses the settlement money without satisfying the subrogation lien, the holder of the lien can recover its subrogation lien amount from the negligent party’s insurance carrier or the victim’s attorney.

            At the outset of any case, the victim’s attorney must determine the existence and amount of all potential subrogation liens.  Prior to any settlement the victim’s attorney can negotiate with the holder of subrogation liens for reduction of the lien and get the reduction agreement in writing.

            If Medicare is the lien holder, there is a formula for lien reduction published in the Code of Federal Regulations.  If the lien holder is a self-funded ERISA plan, such a lien holder cannot be forced to reduce its lien.  If the lien holder is a hospital or insurance carrier, the victim’s attorney can usually negotiate a lien reduction.

            The Texas Civil Practices & Remedies Code now provides for lien reduction in cases where the lien holder is an insurance carrier, but does not affect Medicare, Medicaid, ERISA self-funded plans, Workers Compensation, or Hospital Liens.
