RECENT SETTLEMENT – CEREBRAL PALSY – HOSPITAL LABOR NURSE NEGLIGENCE

            The use of Pitocin caused multiple episodes of tachysystole (more than 6 contractions per 10 minute period).  The labor nurse failed to notify the obstetrician and also failed to lower the Pitocin.  In addition, there were multiple episodes of prolonged decelerations in the baby’s heart beat and multiple episodes of late decelerations of the baby’s heartbeat.  Those decelerations were non-reassuring, which is medical talk for the baby being not able to tolerate the contractions.  Eventually, the baby’s heartbeat variability diminished and the decelerations continued, which indicated that the baby was becoming acidotic and at high risk to suffer brain damage that would lead to cerebral palsy if the baby was not emergently delivered by Cesarean section.

            The above was all occurring between midnight at 9:00 a.m.  The obstetrician called in to check on the mother and baby, and the labor nurse told the obstetrician that everything was just fine.  However, everything was not just fine.  The labor and delivery protocols required the nurse to inform the obstetrician that the baby was exhibiting non-reassuring status, to alert anesthesia for a likely emergency Cesarean section, and to notify the nursery of an impending emergency Cesarean section delivery of a depressed baby in need of vigorous resuscitation.

            When the obstetrician was informed that vaginal delivery was imminent, he appeared in the patient’s room and delivered the baby vaginally, thinking he was about to deliver a baby what was healthy and tolerating labor well.  The baby delivered and was virtually dead, limp, not breathing, no color and with an Apgar score of no more than 2.  There were no nursery personnel present to provide resuscitation for over 5 minutes.  The baby was not breathing at birth and it took over 6 minutes to get the baby breathing.  The baby developed a neonatal encephalopathy syndrome with seizures and multi-organ damage, and eventually cerebral palsy.

            The obstetrician testified that he should have been notified several hours before the delivery of the non-reassuring status and that he would have immediately delivered the baby by emergency Cesarean section, and that none of the brain damage or cerebral palsy would have happened.

            Labor nurses have a duty to recognize signs of fetal distress and timely report signs of fetal distress to the obstetrician.  The failure to do that caused a baby to develop a severe case of very preventable cerebral palsy.
